The Court is not announcing a Primary Election at this time


Redistricting Update from the Bexar County Democratic Party
Dear Democratic Candidates;

Here is a summary of the order signed by Judge Orlando Garcia this morning:

The Court is not announcing a Primary Election schedule at this time.

The Court is encouraging the parties to continue discsussions that may result on stipulations, agreements or concessions for the purpose of preparing of interim maps for the 2012 Primary Elections.

February 7th
Parties must submit constitutional claims being asserted from Supreme Court ruling of Jan 20th, 2012, specifically addressing district or specific geographical areas still an issue of the interim plans.

February 10th (6 p.m.)
Parties representing plaintiffs shall submit briefs and findings of facts and conclusion of law that the court can use in preparing interim redistricting plans.

February 13th -
Deadline for parties to file a responsive brief to the Western District Court's informing parties that they will announce interim plans before DC Court rules and the "not insubstantial" test is applicable to section 5 claims and addressing eight specific issues or additional ones identified by the parties.

February 15th -
Parties will provide oral arguments on all issues relating to the interim plans at 8 a.m.

Note:

The Federal District Court in Washington DC hearing claims against the legislatively drawn maps under Section 5 of the Voting Rights Act issued a memorandum indicating they do not anticipate rendering a decision in the next 30 days. A decision of the DC court would assist the San Antonio court, which has been directed by the US Supreme Court to consider Section 5 claims when drawing interim maps. The Western District court has not heard evidence on Section 5 claims, only Section 2 and constitutional claims. The Western District court is figuring out how to proceed in light of the directive of the US Supreme Court.

If by February 6th the parties to agree to interim maps, the Western District court could issue a new order regarding primary date(s) and whether we will have a unified or split primary. This information will more than likely not be known until after February 15th.
