Redistricting Update from the Bexar County Democratic Party
Dear Democratic Candidates;

Here is a summary of the order signed by Judge Orlando Garcia this morning:

The Court is not announcing a Primary Election schedule at this time.

The Court is encouraging the parties to continue discsussions that may result on stipulations, agreements or concessions for the purpose of preparing of interim maps for the 2012 Primary Elections.

February 7th
Parties must submit constitutional claims being asserted from Supreme Court ruling of Jan 20th, 2012, specifically addressing district or specific geographical areas still an issue of the interim plans.

February 10th (6 p.m.)
Parties representing plaintiffs shall submit briefs and findings of facts and conclusion of law that the court can use in preparing interim redistricting plans.

February 13th -
Deadline for parties to file a responsive brief to the Western District Court's informing parties that they will announce interim plans before DC Court rules and the "not insubstantial" test is applicable to section 5 claims and addressing eight specific issues or additional ones identified by the parties.

February 15th -
Parties will provide oral arguments on all issues relating to the interim plans at 8 a.m.

Note:

The Federal District Court in Washington DC hearing claims against the legislatively drawn maps under Section 5 of the Voting Rights Act issued a memorandum indicating they do not anticipate rendering a decision in the next 30 days. A decision of the DC court would assist the San Antonio court, which has been directed by the US Supreme Court to consider Section 5 claims when drawing interim maps. The Western District court has not heard evidence on Section 5 claims, only Section 2 and constitutional claims. The Western District court is figuring out how to proceed in light of the directive of the US Supreme Court.

If by February 6th the parties to agree to interim maps, the Western District court could issue a new order regarding primary date(s) and whether we will have a unified or split primary. This information will more than likely not be known until after February 15th.

8. Organized a strong recruitment effort to increase precinct chairs in key voting precincts;
9. Set up a monthly Club President's meeting to bring together Democrats throughout Bexar County;
10. Established training sessions for Judicial and Non-judicial candidates on legal and financial requirements;
11. Created a professional and respectful meeting environment for precinct chairs & committee meetings;

Ask the Judge: Validity of mandated tutoring/book reports in truancy cases

In past columns of “Ask the Judge” we addressed the implementation of innovative programs such as mandated tutoring and requiring all truants obtain a public library card and write a two sided book report, on a book they checked out at the public library.

Let’s revisit those two programs in Pct. 2. As the retired teacher of 26 years, I discovered early on as Judge, that both were more viable alternatives to community service. Once implemented, I found them to be a more productive means of re-directing students back to the classroom and finishing their studies. It culminated in them walking the stage with diploma in hand. Following the old adage, “whatever works,” it has proved to be a valuable tool. Besides, it is more educational than punishment oriented.

Critics and detractors point out that writing a book report does nothing to inspire students to return to the classroom. As Judge and former teacher I wholeheartedly disagree. With over one thousand book reports later, it has reaped benefits along with mandated tutoring.

One of the first things I discovered in implementing the book report/public library card was the fact that most truants not only didn’t have a public library card, most had never visited a public library.

Just ensuring that students visit a public library is beneficial. Unlike many of us older folk who in our day visited a public library that only housed rows and rows of books on shelves filled with all size books, the newer public libraries have so much more to offer the student.

Besides books, libraries offer the internet, videos, movies, audio books, exhibits, even social interaction with others your own age and various forms of entertainment that families can share together while at the library.

Mandated tutoring is also a much more viable solution to truancy and even disorderly conduct by public school students. More times than not students disrupt a class because they don’t know the subject material in class and feel inadequate.

They act out because they don’t want their classmates to think they are stupid. Mandating the student to get tutoring in their subjects they don’t do well in, gives them a better self image. They choose the subject. Their choice is very telling. They can justify to their friends that they have to attend tutoring and save face. When they do well with the extra help, they are less likely to disrupt.

In Pct. 2 if the student who skips classes is actually a good student but misses due to boredom or something similar, we mandate that they peer tutor other students. We have seen students going back to school and tutoring their peers in Chemistry, Physics and Algebra! It works.

Lastly as always, if you are due in court, be sure to show up to court on time. It is in everyone’s best interest.

Ask the Judge: Commonly asked questions in Eviction Court

In the last two week’s, you were told that every day when plaintiffs/defendants come into the Justice of the Peace Court for a hearing or trial or simple filing of court papers, there is the usual fear or uncertainty in regards to the outcome for or against either side.

You were again reminded that since Justice of the Peace Court handles misdemeanor cases to include traffic tickets, truancy, evictions, and small claims/civil, various questions are asked by those visiting the court for varying reasons.

In the two previous columns we covered traffic tickets and small claims. This week in evictions, a very common question by the landlord is basically: “how long does the tenant have before I can throw them out for non payment of rent?”

The normal answer is five days if they do not appeal to County Court. If they file an appeal it could take some time.

Another question frequently asked by the landlord is “When can I change the locks?” The answer is again after five days if the tenant doesn’t appeal.

A common question by the tenant is:”What if I don’t move out in five days?” Simple answer: the landlord can file an abstract and a constable’s deputy or two will show up at the residence of the evictee and supervise a crew to place the tenants belongings on the curb, where if left unattended can result in neighbors and others coming by and taking a tenants valuables.

Many new landlords will also ask “when will I get my money the tenants owe me?” Answer: There is no definitive answer. Depending when you evicted the tenant, it may actually take years to collect if at all! It is far easier to evict someone who owes you money, than collecting it.

When a plaintiff shows up to eviction court and the defendant fails to appear which is very common, many plaintiffs ask: “what do I do now?” When a defendant does not show up for court, the judge declares a default like any other docket and awards the plaintiff the amount he/she asked in their case. If the landlord or designee does not appear, the case is dismissed and the landlord has to re-file and start the process all over again.

Lastly as always, if you are due in court, be sure to show up to court on time. It is in everyone’s best interest.

Remembrances of a visit to Dachau & Israel

Back in 1971 while stationed in Augsburg, Germany and again in 1972 when I was released from active duty from the Army in Germany, I took advantage of being overseas to travel and visit various historical places for the next five months.

While still on active duty in 1971, I visited Dachau with some of my Army buddies on a weekend pass. Four of us crammed into a Volkswagen and headed for the concentration camp not knowing what to expect or how to react.

On the trip my buddies teased me since my father was Jewish, although my mother was a Catholic and raised me as such. Although I don’t believe at the time they meant to be cruel, one of them joked that “when we get there we will throw you in the ovens.” For the year we served together up to that time, they referred to me by a nickname, the “Dachau Dough Boy,” a take off of the Pillsbury Dough Boy commercials about biscuits cooking in the oven at the time. Obviously today those comments would be considered very hurtful and extremely offensive and insensitive. We were young and didn’t know any better.

On arrival at the camp, it became a whole different story. As we walked into the camp, to take the tour, we noticed before entering the gate, the sun was shining, the birds were chirping and we expected it to be a typical museum type tour. Once we entered the gates, it suddenly felt cold, deathly quiet and depressing. No chirping birds could be heard. It was as if we had entered another universe.

As we walked around the camp with a guide who had actually spent time incarcerated at the camp, it became apparent the tour would be a life changing experience.. Everyone spoke in hushed tones and acted very respectful about what happened in that camp those many years ago. The guide even showed his tattooed number on his arm. I cringe even now just thinking about.

Never again was I called the “Dachau Dough Boy” and the term was never mentioned in reference to me again. One of my fellow soldiers, Ralph Volweiler, a full-blooded Jew declined to go with us because he had relatives who died in that concentration camp.

My cousin, Sophia who I met in Israel the following summer in Haifa, also survived another concentration camp as a 12 year old girl for over a year. The experience of meeting her and hearing some of her story was gut wrenching and is emblazoned in my mind to this day. I will never forget.

At the time I wrote my mother (June 16th) about the experience that touched my very soul. My mother kept all my letters and I still have that one in my possession she gave me before she died in 2002.

It read in part, “Went to Dachau Saturday to see where they extreminate a lot of Jews. It was a depressing place let me tell you. You could still smell fumes in the gas chambers. The incinerators were eerie too. It was so quiet there and they had pictures of pictures piled up and all sorts of ghastly things. Many visitors were crying.

“It was an experience to be sure. I could almost feel death around me. I must visit Auschwitz, the main camp where they killed 4,000,000 Jews.”

The following year after separating from the Army, I backpacked for five months across the European continent and eventually made my way to Haifa, Jerusalem and Tel Aviv for three weeks. I found my cousin, Sophia in Tel Aviv where she and her husband, Chaim, and two teenage daughters, lived. She showed me letters from my grandfather Robert Ginsberg and we were able to connect for the first time.

I also spent a week in Haifa and stayed on Kibbutz Yagur working the fields like a migrant worker. On my way home to the United States I travelled back to Germany for the 72 Olympics in Munich.

Unfortunately history records that the Israeli athletes were killed at the games, on September 5th, now known as ‘Black September” and my 26th birthday that the terrorists attacked.

Both the visit to Dachau and the Olympics are etched in my memory as two days that will live forever in my heart and remind me, lest I forget, of my Jewish heritage.

Ask the Judge: Commonly asked questions in Small Claims Court

In last week’s column, you were told that every day when plaintiffs/defendants come into the Justice of the Peace Court for a hearing or trial or simple filing of court papers, there is the usual fear or uncertainty in regards to the outcome for or against either side.

You were reminded that since Justice of the Peace Court handles misdemeanor cases to include traffic tickets, truancy, evictions, and small claims/civil, various questions are asked by those visiting the court for varying reasons.

In that column traffic tickets were addressed. This week in Small Claims, a very common question by the plaintiff is: “when I win my judgment, how long does it take to receive my money from the defendant? Answer: There is no definitive answer. Depending who you sued, it may take years to collect! It is far easier to win a judgment against someone who owes you money, than collecting it. In some cases you never collect!

The follow up question is usually: “Is there any way to force them to pay what they owe?” Answer: Yes, but it is a long drawn process. The first step is to wait 10 days to see if the defendant files an appeal with the County Court.

Assuming they don’t appeal you must file for an abstract at the County Courthouse. By filing it and recording it with the County, the debt they incurred stays on the rolls for ten years. If they attempt to sell property, buy a car or sell one for example, the defendant will not be allowed to buy or sell their property until the debt is paid to you in full.

When someone owes you a large amount of money (maximum judgment in JP Court is $10-thousand dollars) it is really difficult but not impossible to collect.

When a plaintiff shows up to court and the defendant fails to appear, many plaintiffs ask: “what do I do now?” When a defendant does not show up for court, the judge declares a default and awards the plaintiff the amount he/she asked in their case.

Defendants, still have 10 days to appeal, however. If defendants don’t appeal, the plaintiffs can file for the abstract. On the other hand if the plaintiff does not show, the case is dismissed “without prejudice.” Without prejudice allows the plaintiff the opportunity to re-file at a later date if necessary, based on unforeseen circumstances that prohibited them arriving to court on time. Example: plaintiff was in involved in a car wreck on the way, or they were stuck in a traffic jam. In Pct. 2 that has happened on more than one occasion and as recently as six months ago. Both sides have still have 10 days to appeal.

Lastly as always, if you are due in court, be sure to show up to court on time. It is in everyone’s best interest.
